The Thriving Workplace Index Terms & Conditions
These Terms and Conditions (“Terms”) apply to The Thriving Workplace Index delivered by Workplace Performance & Wellbeing Institute (ABN 67 346 139 979) (“WPWI”, “we”, “our”, “us”). By purchasing, completing, or participating in The Thriving Workplace Index, you (“the client”, “you”, “your”) agree to these Terms.
These Terms are to be read together with the WPWI General Terms and Conditions. Both documents form part of your agreement with WPWI.
1. Program Overview
1.1 The Thriving Workplace Index is a diagnostic service designed to assess the wellbeing, performance, and culture of your organisation.
1.2 The package includes two components:
- The Thriving Workplace Index: an online diagnostic survey distributed to your organisation’s employees and leaders.
- The Roadmap Session: a strategic meeting with WPWI to discuss findings, followed by a written PDF report outlining key insights and recommendations.
1.3 The Roadmap provides guidance and recommendations only. Implementation of any suggestions is at your organisation’s discretion. WPWI does not provide operational or delivery support unless separately contracted.
2. Completion and Deadlines
2.1 The client is responsible for distributing the Index survey to staff, encouraging participation, and ensuring completion within the timeframe specified in the onboarding email (typically 21 days from the onboarding date).
2.2 WPWI is not responsible for non-completion or delayed participation by staff. Delays in survey completion may extend overall delivery timelines.
2.3 If staff fail to complete the Index by the specified deadline, WPWI reserves the right to proceed with analysis based on the data received. No refund, re-run, or extension will apply.
2.4 WPWI will deliver the Roadmap within 14 days of receiving completed Index data.
2.5 The client will be notified via email once the Roadmap is ready and invited to book a meeting with the WPWI team. The final PDF report will be provided following this meeting.
3. Fees and Payment
3.1 Full payment is required upfront before WPWI commences the Index process.
3.2 Payment may be made via ThriveCart or by invoice, as specified at the time of purchase.
3.3 Once the Index has been sent or commenced, all sales are final. Refunds will not be provided, except as required under the Australian Consumer Law.
4. Confidentiality and Data
4.1 WPWI respects the confidentiality of all data collected through The Thriving Workplace Index. Individual responses are aggregated and anonymised before analysis.
4.2 WPWI may use de-identified, aggregated data for research, reporting, or benchmarking purposes. No identifiable organisation or individual information will ever be shared publicly.
4.3 Both parties agree to maintain confidentiality regarding all non-public business or personal information shared during the process. These obligations continue beyond the completion of the Index and Roadmap.
5. Intellectual Property
5.1 All survey questions, methodologies, frameworks, and materials used within The Thriving Workplace Index and Roadmap remain the exclusive intellectual property of WPWI.
5.2 The client may not copy, reproduce, modify, distribute, or use any part of the Index or Roadmap materials for commercial or training purposes without WPWI’s prior written consent.
5.3 The Roadmap is provided for internal organisational use only and must not be shared externally without approval.
6. Roadmap and Implementation
6.1 The Roadmap provides insights, recommendations, and suggested next steps based on the data provided. These recommendations are advisory in nature and do not guarantee any particular outcomes.
6.2 WPWI is not liable for the client’s decision to implement or not implement any recommendation.
6.3 Any further engagement, program, or service referenced in the Roadmap may be available at an additional cost, subject to separate agreement with WPWI.
6.4 The Index results and Roadmap remain valid for six (6) months from the date of delivery, after which WPWI makes no representation that the data reflects current organisational conditions.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, WPWI disclaims all liability for any indirect, incidental, or consequential loss arising from participation in The Thriving Workplace Index.
7.2 WPWI does not guarantee any specific results, outcomes, or improvements following completion of the Index or implementation of the Roadmap.
7.3 Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
8. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
