These Terms and Conditions apply to all programs, workshops, consulting services, events and products offered by Workplace Performance & Wellbeing Institute ABN 67 346 139 979 (referred to as “WPWI”, “we”, “us”, or “our”).
By purchasing, enrolling in, or participating in any WPWI service, you agree to be bound by these Terms and Conditions, together with any other written agreements or program-specific terms provided at the time of purchase or registration. These documents together form the entire agreement between you and WPWI.
1.1 These Terms apply to all WPWI offerings, including but not limited to:
(Click the program name below to view its specific Terms and Conditions, which form part of this Agreement.)
1.2 Each program, event, or workshop may have its own additional or varied terms and conditions. Those specific terms form part of these Terms and Conditions and can be accessed at the relevant program or event webpage.
1.3 WPWI reserves the right to rename, rebrand, or modify the structure, format, or title of any of its programs, services, or events at any time.
Such changes do not alter the nature or substance of the services provided and do not affect the enforceability of these Terms and Conditions.
2.1 These Terms become binding when you agree to proceed with a service, complete a purchase, use a WPWI product, or make any payment to WPWI.
2.2 You acknowledge that WPWI may update these Terms from time to time. The version published at wpwi.org/termsandconditions at the time of your purchase or participation will apply.
3.1 WPWI provides professional consulting, education and wellbeing services delivered online, face-to-face, or through a blended model.
3.2 Where sessions are scheduled, WPWI will make all reasonable efforts to deliver them at agreed times and dates. Should unexpected circumstances arise, WPWI reserves the right to reschedule within reasonable timeframes.
3.3 Access to online platforms or materials, where provided, is for the term specified at purchase. Login details are personal to you and must not be shared.
3.4 WPWI is not a medical or psychological service provider. Our programs do not diagnose, treat, or cure mental health or medical conditions. Participants should seek advice from qualified professionals as appropriate.
4.1 You agree to:
4.2 You are responsible for your own wellbeing during participation. If you are under the care of a mental health or medical professional, you should consult them before engaging in any WPWI program.
5.1 You agree to pay all fees as stated at the time of booking, quotation, or invoice.
5.2 Payment may be made via secure online checkout (e.g., ThriveCart, Stripe, PayPal) or direct invoice (e.g., Xero).
5.3 Where a payment plan is offered, you agree to complete all instalments in full. Withdrawal, cancellation, or non-attendance does not void your payment obligation.
5.4 A minimum 20% deposit may be required at the time of booking for certain services, along with any agreed travel costs. Remaining balances are due within 14 days of booking unless otherwise agreed in writing.
5.5 If a payment is dishonoured, you are responsible for all associated fees, collection costs, and reasonable legal expenses incurred by WPWI.
5.6 The cost of workshops or programs is based on the participant numbers specified in your quotation or booking. Additional attendees (in-person or virtual) may incur extra fees, which will be invoiced accordingly. If fewer participants attend than originally booked, no refund or fee reduction will apply, as pricing is determined by the agreed number of participants, not final attendance.
6.1 WPWI commits significant time and resources to each client and event. For that reason, refunds are not available for change of mind, inability to attend, or change in personal circumstances.
6.2 WPWI complies with its obligations under the Australian Consumer Law. You may be entitled to a remedy if our services fail to meet consumer guarantees.
6.3 If WPWI must cancel a session, event, or program due to unforeseen circumstances, you will be offered a rescheduled date, transfer credit, or refund at WPWI’s discretion.
6.4 Certain services or events may have their own cancellation and transfer policies (e.g., conference or networking tickets). Those specific conditions will apply and form part of this agreement.
7.1 WPWI may terminate services or online access immediately if you breach these Terms.
7.2 You may terminate participation at any time; however, this will not entitle you to a refund of any kind unless required under Australian Law.
7.3 WPWI may terminate an engagement if circumstances beyond its control prevent delivery. In such cases, WPWI will refund the unused portion of the fee or provide an appropriate alternative.
8.1 Each party agrees to maintain confidentiality over any non-public business, personal, or organisational information disclosed during or in connection with a WPWI program or engagement.
8.2 Confidential information may only be shared with others if required by law or with the express written consent of the disclosing party.
8.3 WPWI may use aggregated, de-identified data to improve its services or for reporting and research purposes.
8.4 These confidentiality obligations survive the completion or termination of this agreement.
9.1 All content, materials, frameworks, presentations, and tools created by WPWI remain its intellectual property.
9.2 You are granted a limited, non-exclusive, non-transferable licence to use materials solely for your personal or internal business purposes.
9.3 You must not reproduce, adapt, distribute, or sell any WPWI material in whole or part without written permission.
9.4 WPWI may record workshops, keynotes, or events for quality, training, or marketing purposes. By participating, you consent to the use of your likeness (including image, voice, and participation) in such recordings without compensation, unless otherwise agreed in writing.
9.5 Unless otherwise requested in writing, you grant WPWI permission to use your organisation’s name and logo for reasonable marketing and promotional purposes, including on our website, proposals, and social media. WPWI will not disclose confidential project details or sensitive data without prior written consent.
10.1 WPWI collects personal information necessary to deliver its services. Your data is handled in accordance with Australian Privacy Principles.
10.2 WPWI’s separate Privacy Policy (available at https://wpwi.org/privacy-policy/) forms part of these Terms.
10.3 WPWI takes reasonable steps to secure data but cannot guarantee against unauthorised access or loss. You are encouraged to maintain your own secure records of important information.
11.1 WPWI provides education, mentoring, and consulting services intended to support workplace wellbeing and performance. Individual and organisational results may vary based on implementation, engagement, and context.
11.2 WPWI does not guarantee any specific results, outcomes, or improvements arising from participation in its programs, workshops, events, or consulting services. The success and benefit of any engagement depend on each client’s unique circumstances, commitment, and implementation of recommended strategies. WPWI is not liable for any expected results not achieved following participation or completion of services.
11.3 To the fullest extent permitted by law, WPWI disclaims all liability for any indirect, incidental, or consequential loss arising from participation in its programs or use of its materials.
11.4 Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
11.5 Where permitted by law, WPWI’s total aggregate liability to you is limited to the amount actually paid for the service or program.
11.6 You agree to indemnify WPWI against any claim, loss, or damage arising from your breach of these Terms or misuse of any WPWI materials.
WPWI will not be held liable for any delay, interruption, or failure to deliver services caused by circumstances beyond its reasonable control, including natural disasters, pandemics, strikes, venue closures, or government restrictions. In such cases, WPWI will make reasonable efforts to provide an alternative arrangement or reschedule.
13.1 In the event of a dispute, both parties agree to first attempt resolution through good-faith discussion.
13.2 If unresolved, either party may refer the matter to mediation via the Queensland Small Business Commissioner or an agreed independent mediator.
13.3 If mediation fails, either party may pursue legal remedies in the courts of Queensland, Australia.
