Project Thrive Terms & Conditions
These Terms and Conditions (“Terms”) apply to Project Thrive, a workplace wellbeing and performance program delivered by Workplace Performance & Wellbeing Institute (ABN 67 346 139 979) (“WPWI”, “we”, “our”, “us”).
By purchasing, engaging in, or participating in Project Thrive, you (“the client”, “you”, “your”) agree to the following.
These Terms are to be read together with the WPWI General Terms and Conditions. Both documents form part of your agreement with WPWI.
1. Program Structure and Delivery
1.1 Project Thrive is a tailored program designed to enhance organisational wellbeing, performance, and culture. It may include, but is not limited to:
- Leadership roundtables and development sessions
- Team workshops and breakthrough sessions
- 1:1 coaching or advisory sessions with leaders, HR representatives or employees
- Wellbeing sessions such as mindfulness or resilience training
- Workplace assessments through The Thriving Workplace Index
1.2 Programs may run for 3, 6 or 12 months, as agreed and stated in your invoice or service agreement.
1.3 All scheduled sessions must be completed within the contracted program term. Sessions not completed within the term will expire and cannot be carried over unless agreed in writing.
1.4 Project Thrive may be delivered online, face-to-face, or as a combination of both. Where face-to-face delivery occurs, the client is responsible for providing a suitable venue with necessary facilities (including AV and seating) and covering all associated venue costs.
1.5 Completion of The Thriving Workplace Index is a condition of engagement. The Index will typically be conducted at the start, middle and end of the program to measure outcomes.
2. Fees and Payment
2.1 Fees are payable as set out in your quotation or invoice. Payment may be made upfront or in instalments as agreed at the time of contracting.
2.2 Where sessions involve travel, all agreed travel and accommodation costs will be included on the first invoice and payable in line with standard payment terms.
2.3 WPWI reserves the right to suspend or postpone services if any payment remains overdue until the account is brought up to date.
2.4 All payments are non-refundable once the program has commenced, except as required under the Australian Consumer Law.
2.5 If the client cancels or terminates the program early, the full contracted amount remains payable, reflecting WPWI’s commitment of time and resources.
3. Rescheduling and Cancellations
3.1 Requests to reschedule a session must be made at least 10 business days’ notice prior to the scheduled date and are subject to WPWI’s availability.
3.2 A rescheduling fee may apply for changes made within 10 business days or repeated reschedule requests.
3.3 If WPWI must reschedule due to unforeseen circumstances, a mutually suitable alternative date will be arranged without penalty.
4. Confidentiality and Data
4.1 Both parties agree to maintain confidentiality regarding all non-public business or personal information shared during the program.
4.2 WPWI may use aggregated, de-identified data from The Thriving Workplace Index or program outcomes for research, benchmarking, or reporting purposes.
4.3 These confidentiality obligations continue after the completion of Project Thrive.
5. Intellectual Property
5.1 All Project Thrive materials, including slides, handouts, frameworks, assessments, and recordings, remain the intellectual property of WPWI.
5.2 You are granted a limited licence to use these materials internally within your organisation only. They must not be reproduced, distributed, or shared externally without WPWI’s written consent.
6. Marketing and Communications
6.1 Unless otherwise requested in writing, you grant WPWI permission to reference your organisation’s name and logo for marketing purposes (e.g. website, proposals, or social media).
6.2 WPWI will not disclose confidential information or internal program results without prior consent.
7. Health and Safety
7.1 WPWI takes reasonable steps to ensure a safe and professional learning environment.
7.2 Participants are responsible for their own health, wellbeing, and conduct during all sessions.
7.3 WPWI is not liable for any pre-existing conditions, injuries, or incidents that occur during participation, except as required by law.
8. Force Majeure
WPWI is not liable for any delay, interruption, or failure to deliver services caused by circumstances beyond its reasonable control, including illness, natural disasters, travel restrictions, or government directives. In such cases, WPWI will make reasonable efforts to reschedule affected sessions.
9. Limitation of Liability
9.1 Project Thrive provides education, facilitation, and strategy guidance intended to improve workplace wellbeing and performance. It does not constitute legal, financial, or medical advice.
9.2 To the maximum extent permitted by law, WPWI disclaims all liability for any indirect, incidental, or consequential loss arising from participation.
9.3 Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
10. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
